The petitioner seeks regular bail in connection with Alamganj P.S. Case No. 67 of 2017 registered for the offence punishable under section 394 of the IPC.

Earlier the prayer for regular bail was rejected vide order dated 18.04.2017 passed in Cr. Misc. Case No. 15234 of 2017 by this Court with a direction to the trial court to expedite the trial.

Learned counsel for the petitioner submits that this application has been filed for grant of bail on the ground that trial has commenced and petitioner is in custody for more than five months.

Patna High Court Cr.Misc. No.34819 of 2017 (2) dt.02-08-2017 2/2 Learned APP opposes the prayer for bail.

Having heard both sides, in view of the facts and circumstances, I am not inclined to enlarge the petitioner on bail and accordingly his prayer stands rejected in connection with Alamganj P.S. Case No. 67 of 2017, pending in the Court of learned Addl. Chief Judicial Magistrate, Patna City(Patna). However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of six months. If trial is not concluded within the said period, petitioner may renew his prayer for bail. With the above observation, this application is dismissed.
