This is an application for regular bail in connection with Nutan P. S. Case No. 183 of 2017 registered for the offences punishable under Section 414 r/w 34 of the Indian Penal Code and Section 11(D)(E)(F) of Prevention of Animal Cruelty Act, 1960.
Allegation, as per ASI, Nautan Police Station is that he received a message from SHO, Nautan, that a Bolero Pick-up van had turned turtle near Badli More. He proceeded towards the place of occurrence and found that cattle were being carried in it. One person was also found in an injured condition in the van.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in the present case.
Patna High Court Cr.Misc. No.6697 of 2018(3) dt.27-02-2018 2/2 Neither he has been arrested on the spot nor anything has been recovered from his possession. He is the owner of the vehicle and it is used to be run by the driver of vehicle. He is not concern with the cattle recovered from the vehicle. He has got no criminal antecedent and is in jail custody since 3.1.2018. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-XII, Siwan, in connection with Nautan P.
