JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2020 This application, for grant of anticipatory bail, arises out of Goraul P.S. Case No. 183 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 379, 504 and 307 of the Indian Penal Code.

Allegation against the petitioner is of assault by butt portion of the pistol on the head and neck of the informant and there is allegation of assault against other accused persons also. Submission of learned counsel for the petitioner is that as a matter of fact, the daughter of co-accused was kidnapped by the son of the informant for which, he has lodged a case and due to that a scuffle took place and for that there was case and counter case between the parties and the injuries sustained by the informant was found simple in nature except one injury about which, opinion has been kept reserved.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 183 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
