The petitioners are apprehending their arrest in connection with Katoriya P.S.Case No.158 of 2018 , registered for offences punishable under Sections 147, 148, 341, 323,341, 307/504 of the Indian Penal Code and Sections 3, 4, and 5 of the Explosive Substance Act..

Allegation as per FIR against the petitioners is that the petitioners and other accused persons have assaulted the informant by fists and slaps and there is allegation against three other accused persons that they exploded bomb. Submission of the learned counsel for the petitioners is that the allegation against this petitioner is of assault by fists

Patna High Court CR. MISC. No.14994 of 2019(4) dt.02-05-2019 2/2 and slaps and nothing else as well as he has no criminal antecedent and the other accused persons having similar allegation have been granted bail by a Co-ordinate Bench of this Court, vide order dated 27.2.2019 passed in Cr. Misc. No.12186 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of Raushan Kumar, J.M. Ist Class, Banka in connection with Katoriya P.S.Case no.158 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
