The petitioner apprehends his arrest in connection with Buxar (M) P.S. Case No. 200 of 2018 registered for the offence punishable under section 392 of the Indian Penal Code. The informant of this case is an Invigilator of a Finance Company. When he was going by his motorcycle in relation to his personal work, two motorcyclists came there and blocked his way. The miscreants were 4 in number. At the point of pistol, they snatched his bag containing Rs.9,000/- cash. They also snatched three mobile sets.
Learned counsel for the petitioner has submitted that the name of the petitioner has figured only on the basis of
Patna High Court CR. MISC. No.16449 of 2020(2) dt.06-12-2021 2/2 confessional statement of co-accused and there is no incriminating material against him at all. He has mentioned in paragraph 3 of the bail application that a criminal case against the petitioner is pending as Buxar (M) P.S. Case No. 299 of 2018 under sections 399, 402, 414 of the Indian Penal Code and sections 25 (1-b) a and 35 of the Arms Act.
Considering the above facts and circumstances, the learned court below after verifying the submissions of the learned counsel from the case diary about his criminal antecedent, the petitioner above named, in the event of his arrest or surrender, within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 200 of 2018, subject to condition as laid down under section 438(2) Cr. P.C. If the submission of the petitioner is not found true then the court below will be at liberty to pass an appropriate order, including cancel the bail bonds of the petitioner.
