The petitioner apprehends his arrest in a case under Section 420, 467, 468, 471, 120(B) of the Indian Penal Code. One Mahesh Kumar was appearing at the examination of recruitment of Constable having admit card of the petitioner.

It is submitted that petitioner lost his admit card and it has nowhere come that petitioner set up Mahesh Kumar to appear at the examination on his behalf and Mahesh Kumar has already been enlarged on regular bail.

Having considered the fact that it was the petitioner who appears to have set up Mahesh Kumar to appear in the examination for recruitment of Constable and Mahesh Kumar was

Patna High Court Cr.Misc. No.15339 of 2016 (2) dt.25-04-2016 2/2 apprehended, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. If the petitioner surrenders in the court below (learned CJM, Bhojpur, Ara in Ara Nagar P.S. case No. 404 of 2014) and prays for regular, learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that Mahesh Kumar has already been enlarged on regular bail.
