Mr.Bharat Bhushan ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-07-2024 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Semra P.S. Case No. 24 of 2023 for the offences punishable under Sections 366, 328, 302/34 of the Indian Penal Code.

3. As per allegation, on 31.12.2022, the petitioner took away informant's sister with an intention to marry her. The informant came to know that his sister has been killed by the petitioner by administring medicine. The dead body of the deceased was found near Kadmahawa Poultry Farm, after which the informant brought the dead body of the deceased.

4. The learned counsel for the petitioner has submitted that there is no eye witness of the occurrence. The informant though made allegation that the petitioner, after committing murder of the sister of the informant, fled away after leaving the dead body, but as a matter of fact, she died due to ailments.

He has further submitted that when the informant came to know the real fact, she filed a petition before the Court of learned Chief Judicial Magistrate in which she has stated that the petitioner is innocent and the deceased died due to excessive bleeding as she was pregnant.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, especially the fact that the informant herself has stated that the petitioner is innocent, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial MagistrateIst, Class Bagaha West Champaran in connection with Semra P.S. Case No. 24 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
