The petitioners apprehend their arrest in Sheikhpura P.S. Case No.465 of 2018 registered under Sections 147, 148, 149, 323, 307, 353, 379, 427, 337, 338 of the Indian Penal Code, under Section 3/4 of Prevention and Damage to Public Property Act and Rule 40 of B.M.M.C.

The informant, Mining Inspector, alleged that he intercepted many vehicles carrying overloaded boulders without valid permit but thereafter Dani Yadav and others started pelting stones on the vehicle of the informant.

The learned counsel for the petitioners submits that names of the petitioners have also figured but no specific

Patna High Court CR. MISC. No.15122 of 2019(2) dt.12-03-2019 2/2 allegation is made against the petitioners. Petitioners have no manner of concern with the occurrence. No tractor of the petitioners was intercepted.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No.465 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
