====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 28-07-2016 Heard the learned counsel, Mr. Jitendra Kishore Verma, for the petitioner.

Perused the order dated 17.12.2015 passed by Munsif Ist, Saran at Chapra in Title Suit No.483 of 2013 whereby the learned Court below has allowed the amendment application filed by the defendant respondents for amendment in the written statement.

It is admitted by the petitioner that the suit is at the very initial stage, i.e., the evidence has not yet started on the date of passing the impugned order.

In view of the above facts and circumstances of the case, in my opinion, it is not a case for interference in supervisory jurisdiction. However, if so advised, the petitioner is at liberty to rebut the amendment of portion of the written statement by amendment of the plaint. Thus, this writ application is accordingly dismissed with aforesaid liberty.
