ANJANA MISHRA ORAL ORDER 20-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 01.09.2017 in connection with Bagengola P.S. Case No.39 of 2017 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and only on the basis of the confessional statement made by one Binod Yadav before the police, that the name of the petitioner has surfaced in connection with the present case. He further submits that such confessional statement has no evidentiary value. It is further submitted that neither any recovery has been made from the possession of the petitioner nor has he been put on T.I. Parade.
