The petitioner has been in custody since 03.11.2015 in connection with Pothiya P.S. Case No. 238/2015 registered for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-B)A, 26 of the Arms Act.
Learned counsel for the petitioner submits that only because he had refused to co-operate and become an eye-witness in the present case, the petitioner was roped in for theft of the motorcycle which was recovered from a road side. It is further submitted that the motorcycle was not recovered from the conscious possession of the petitioner.
Having heard learned counsel for the petitioner and
Patna High Court Cr.Misc. No.11740 of 2018 (3) dt.09-03-2018 2/2 learned Additional Public Prosecutor appearing on behalf of the State, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Kishanganj, in connection with Pothiya P.S.
