This application for grant of regular bail arises out of Motipur P.S. Case No.269 of 2022 registered for the offence punishable under sections 279/304-A of the Indian Penal Code. Later on, sections 302 and 120-B of the Indian Penal Code was also added.

The deceased is said to have died in a road accident and thereafter he was taken to the hospital where he died during treatment.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case on the basis of suspicion. Initially, the F.I.R. was lodged against the unknown persons but thereafter the father of the

Patna High Court CR. MISC. No.24312 of 2025(2) dt.30-04-2025 2/2 deceased gave an application stating therein that the petitioner along with others committed murder of his son. There is no eye witness to the alleged occurrence.

Learned counsel for the petitioner has drawn the attention of this Court to the order dated 24.08.2023 passed in Criminal Miscellaneous No.7111 of 2023, by which coaccused Prabhat Kumar has been granted bail by a coordinate Bench of this Court.

The petitioner is in custody since 20.08.2024.

Considering the facts and circumstances of the case as well as the submissions of learned counsel for the petitioner, this bail application is allowed. 8.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Muzaffarpur/concerned Court below, in connection with Motipur P.S. Case No.269 of 2022.
