20-09-2017 Heard Sri Alok Kumar Alok, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner purely on parity.

It was submitted by learned counsel for the petitioner that petitioner's prayer for bail was earlier rejected on 15-12-2016, vide Cr. Misc. No. 44331 of 2016. Subsequently, two co-accused, almost in similar circumstances, have been granted bail. One of the co-accused Sunil Sahni was granted bail on 16-08-2017, vide Cr. Misc. No. 33199 of 2017 and another accused namely Gopi Kumar Sahni has been granted bail on 21-06-2017, vide Cr. Misc. No. 25189 of 2017. Considering the fact that other co-accused, almost in similar circumstances, have been granted bail, there is no reason

Patna High Court Cr.Misc. No.38053 of 2017(2) dt.20-09-2017 2/2 to refuse the prayer for bail of petitioner.

Accordingly, let the petitioner namely Anil Sahani be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 8th Addl. Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Motipur P.S. Case No. 133 of 2016.
