The petitioner apprehends his arrest in a case registered for the offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

Allegation in the F.I.R. is that the police patrolling team got a confidential information that some accused persons are planning to commit dacoity. Accordingly, they proceeded and intercepted number of accused persons, from whose possession, arms and ammunition have been recovered. Name of the petitioner transpired on the basis of confessional statement of co-accused, who was apprehended on spot. No incriminating article has been recovered from possession

Patna High Court CR. MISC. No.15362 of 2023(3) dt.22-06-2023 2/2 of the petitioner and only on confessional statement, petitioner has been made accused.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner has got one criminal antecedent of similar nature.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
