JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections419, 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged in the FIR that In-charge Headmaster of school namely Raj Kumar Sah defalcated `7,71,548/- with regard to construction fund of the school. The petitioner was not named in the FIR, his named sprang up during investigation. It is submitted by learned counsel for the petitioner that the petitioner was simply a teacher in the school and he has no financial problem. The impugned order also does not reflect any specific material collected during investigation against the petitioner. Moreover, the petitioner has already retired. Considering the aforesaid facts, let the above named

No.10015 of 2015 (2) dt.24-04-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Pranpur P.S. Case No. 137 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
