Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 302, 201 and 120B/34 of the Indian Penal Code.

Petitioner was owner of the vehicle of which the husband of the informant was driver. The husband of the informant was called by the petitioner on phone. Thereafter, he left along with co-accused Sandeep Yadav. Subsequently, his murder was committed by unknown person.

Submission is that only material is suspicion and co-accused Shakil Ahmad @ Tamanna has been allowed bail by a Coordinate Bench of this Court vide order dated 11.01.2018 passed in Cr. Misc. No. 54918 of 2017.

No.8303 of 2018 (3) dt.21-03-2018 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Forbesganj Police Station Case No. 616 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
