JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Bahera P.S. Case No. 261/13, disclosing offences under Sections 147, 148, 149, 341, 323, 324 and 302 of the Indian Penal Code.

At the very outset, it has been pointed out by learned counsel for the petitioners that the arrest of the petitioners was stayed. However, it appears that process under Section 82 of the Cr.P.C. has already been exhausted in this case. It has been submitted that other accused persons have been granted the privilege of anticipatory bail by different coordinate Benches of this Court vide order dated 21.08.2015 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.19021 of 2019(2) dt.07-05-2019 2/2 35672 of 2015 and vide order dated 20.09.2017 passed in Cr. Misc. No. 20974 of 2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that process under Section 82 Cr.P.C. has already been exhausted, petitioners are directed surrender before the court below within a period of four weeks and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record and also after considering that other co-accused persons have been granted th privilege of anticipatory bail, if possible on same day, without being prejudiced by this order.
