Petitioner seeks bail in a case registered under Sections 302, 120B/34 of Indian Penal Code.

Petitioner's counsel submits that the prime accused in this case is one Dablu Bhagat. Petitioner claims parity with Vikash Kumar @ Bhibhash Thakur @ Bhibhash Kumar @ Bikash Thakur who has been allowed bail by this Court in Cr Misc No 16649 of 2018, Manoj Sah @ Manoj Kumar Sah, who has been allowed bail by this Court in Cr Misc No 8284 of 2018, Sonu Bhagat and Deepak Bhagat who have been allowed bail by this Court in Cr Misc No 2314 of 2018. The petitioner has no criminal antecedent and he is in custody since 30.10.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge III, Purnea in Sessions Trial No 396 of 2017 arising out of Dhamdaha Police Station Case No 38 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
