The petitioner seeks bail in a case instituted under Sections 302, 498(A) of the Indian Penal Code but the cognizance has been taken only under Section 306 of the Indian Penal Code. The allegation against the petitioner is of committing torture upon the victim as a result of which, the deceased committed suicide.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.03.2017. The charge sheet has been submitted for an offence under Section 306 of the Indian Penal Code in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses
Patna High Court Cr.Misc. No.35092 of 2017 (2) dt.10-08-2017 2/2 alleged against the petitioner. The petitioner has falsely been implicated in the present case. The cognizance has been taken for an offence under Section 306 of the Indian Penal Code against the petitioner. There is no allegation of inducement alleged against the petitioner.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III Jamui, in connection with Laxmipur P.S. case No.50 of 2016.
