ANJANA MISHRA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Garkha P.S. Case No.181 of 2013 for allegedly having committed the offence under Sections 376 and 511/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that for an occurrence alleged to have taken place on 30.9.2013, an F.I.R. was lodged on 3.10.2013, for which no plausible explanation has been offered. Learned counsel for the petitioner further submits that the petitioner is not named in the F.I.R. and that he has been made accused solely on the confessional statement of co-accused Mahesh Singh, who is said to have escaped from

Patna High Court Cr.Misc. No.19487 of 2015 (4) dt.28-09-2015 2/2 the vehicle and on the basis of the confessional statement, the petitioner is said to have been driving the vehicle, by which the girl was possibly taken away.

Considering the aforementioned facts and circumstances and that the petitioner is a man of clean antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Garkha P.S. Case No.181 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
