The petitioner seeks bail in connection with Imamganj P.S. Case no. 154 of 2017 registered under Section 272 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act 2016.

20 lts. of illicit Mahua liquor is said to have been recovered from the maize field of the petitioner and petitioner managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Though, as per FIR, the alleged recovery is said to have been made from the maize field but seizure list

Patna High Court Cr.Misc. No.8466 of 2018(2) dt.17-02-2018 2/2 indicates recovery of the same from the maize field of Shankar Bhuain and petitioner has no concern either with the seized liquor or with the said Shankar Bhuain. Though, one case under Excise Act has been lodged against the petitioner, but he is on bail in the said case. The petitioner has been languishing in custody since 30.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Imamganj P.S. Case no. 154 of 2017.
