JUSTICE PARTHA SARTHY ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Tanti P.S. Case No. 91 of 2019 registered under sections 307 of the Indian Penal Code and section 27 of the Arms Act.
As per allegation in the FIR, 3-4 accused persons were seen in the boundary of NTPC plant and on being challenged, they fired causing injuries to one of the police personnel. Later the petitioner was arrested and confessed to having committed the crime.
It is submitted by learned counsel for the petitioner that the application for bail of the petitioner in the present case
Patna High Court CR. MISC. No.15146 of 2020(2) dt.05-06-2020 2/2 was dismissed vide order dated 9.1.2020 (Annexure-1) passed in Cr. Misc. No. 63100 of 2019 giving liberty to the petitioner to renew his prayer for bail once charges have been framed against him. Petitioner is in custody since 13.6.2019 and as would be evident from the order contained in Annexure-3 to the petition, charges have been framed against the petitioner on 29.1.2020. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the liberty granted to the petitioner in the order dated 9.1.2020 (Annexure-1), the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with S.T. no. 44 of 2020 (arising out of Tanti P.S. Case No. 91 of 2019) on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- XVIIth, Muzaffarpur.
