The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. The prosecution case is that the petitioner assaulted with Dab on the neck of the informant causing injury on the right side of head and repeated the blow causing injury on the left hand when the other accused persons assaulted with fists and slaps.

It is submitted by learned counsel for the petitioner that for the occurrence of 07.12.2015 the FIR was registered on 24.12.2015. The injury of the informant has been

No.15235 of 2016 (2) dt.12-04-2016 2/2 found to be simple in nature caused by hard and blunt substance whereas the petitioner alleged to have caused injury with sharp cutting weapon. There is a counter version of the occurrence, though, the counter version is also of 24.12.2015. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and the accusation being not corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Saran at Chapra in connection with Revelganj P.S.
