2. The petitioner has preferred this application for grant of regular bail in connection with Harnaut P.S. Case No. 422 of 2021 dated 12.09.2021 registered for the offence punishable under Sections 498A read with Section 34 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have tortured the informant mentally and physically due to non-fulfillment of demand of Rs. 3 lakh as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a Railway Employee. As per Annexure-3, the petitioner had filed a Matrimonial Case No. 266/2021 on 20.09.2021 under Section 9 of the Hindu Marriage Act for the restoration of the conjugal life but O.P. No. 2 has not come with the petitioner. There is general and omnibus allegation against the petitioner who is husband of the informant. The petitioner neither demanded any dowry nor tortured the informant. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para-3 of the bail petitioner. The petitioner is in custody since 20.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda in connection with Harnaut P.S. Case No. 422 of 2021.
