2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Pasraha P.S. Case No. 182 of 2023, lodged on 08.07.2023, under Sections 302/342/323/34/120B of the Indian Penal Code.
3. Earlier prayer for bail of the petitioner was rejected vide order dated 04.10.2024 passed in Cr. Misc. No.53507 of 2024 with liberty to renew his prayer for bail four months after framing of the charge.
4. Learned Counsel for the petitioner submits that
Patna High Court CR. MISC. No.18995 of 2025(3) dt.20-06-2025 2/3 charge has been framed on 12.02.2024. He submits that petitioner is in custody since 20.09.2023. Counsel further submits that the petitioner has only allegation that he is member of the mob. Other accused persons, whose involvement have been made in the FIR, have been released on bail after framing of the charge, if not framed, by a coordinate Bench of this Court vide Annexure-3. Counsel submits that the family members have been made accused.
5. Learned counsel for the State opposes the prayer for bail and submits that progress report has been called for.

On perusal of the progress report it transpires that in this case nothing specific has come against the present petitioner and five independent witnesses have been examined after framing of the charge i.e., 12.02.2024. This Court is of the view that no purpose shall be solved keeping the petitioner in custody.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Additional Sessions Judge-VII, Khagaria, in connection with Pasraha P.S.
