JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in connection with Narhat P.S. Case No. 309 of 2018 registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2016.
As per allegation, about 448 liters of illegal liquor was recovered from the vehicle, however, counsel for the petitioner submits that the petitioner is not named in the FIR and nothing has been recovered from his conscious possession. It is urged that the co-accused Anil Yadav, who was apprehended with consignment, has already been granted bail by this Court vide order dated 28.01.2019 passed in Cr. Misc. No. 80335 of 2018. It is further urged that he is in judicial custody since 07.02.2020

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down on account of pandemic Covid-19 to the satisfaction of Additional District Judge-II-cum-Special Judge, Nawada in connection with Narhat P.S. Case No. 309 of 2018 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
