JUSTICE SANJAY PRIYA ORAL ORDER 30-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Patrakar Nagar P.S. Case 224 of 2017 instituted for the offence under Sections 406, 420, 414, 417, 467, 468, 471, 120B of the Indian Penal Code and Section 66(c) of I.T. Act.

It has been submitted that petitioner was not arrested at the place of occurrence and there is no recovery of any incriminating article from his possession. He was remanded in this case on the basis of self confessional statement. It is alleged in the written report that four persons were standing near the van and on search, some documents, cell phones, equipments, devices etc. were recovered from the van. The persons present there, failed to give any satisfactory reply.

Patna High Court Cr.Misc. No.39012 of 2017 (3) dt.30-08-2017 2/2 On query, they disclosed that on the direction of the mastermind behind the NEET question paper leak scam, they have come to collect question papers from the bank and send to the respective Centres.

The co-accused persons with similar allegations have been granted bail by coordinate Benches of this Court including the orders of this Court, vide orders dated 19.08.2017, 11.08.2017, 26.07.2017, 01.08.2017 and 19.08.2017 passed in Cr. Misc. Case Nos. 38868 of 2017, 38188 of 2017, 31209 of 2017, 35433 of 2017 and 39439 of 2017 respectively. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Kumari Vijaya, learned Additional Chief Judicial Magistrate, Patna, in connection with Patrakar Nagar P.S.
