The petitioner, who is in custody, seeks bail in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018 registered for the offence punishable under Sections 363 and 370 of the Indian Penal Code but subsequently Sections 302, 201 and 120B of I.P.C. was added.

Informant is the brother of the deceased, who has stated in his written complaint that his younger brother Bholu Sharraf on 14.01.2018 had gone outside at 9:00 PM and has not returned since and his mobile is also switched off. On the basis of FIR by informant the investigation was carried out by the police and the body of the deceased was recovered. The name

Patna High Court Cr.Misc. No.15196 of 2018(3) dt.06-04-2018 2/2 of the petitioner has surfaced in this case on the confessional statement made by one Pani Mandal. In para 17 of the case diary in which, in his confession he has stated that there was some altercation between the deceased and Aman Kumar, upon which Aman Kumar fired upon the deceased and he was killed. The allegation made in confessional statement against the petitioner is that he was also one of the accused present there, except that confession there is no incriminating materials against the petitioner. Petitioner has no criminal antecedent and he is in custody since 06.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018.
