2. The petitioner seeks regular bail in connection with S.Tr. No. 29/2024 arising out of P.S. Case No. 285/2023 lodged on 19.06.2023 under Section 25(1-b)a, 26 and 35 of the Arms Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 06.12.2023 passed in Cr. Misc. No. 64959 of 2023 with liberty that he may renew his prayer for bail after framing of charge. Counsel further submits that charge has been framed on 18.01.2024. There were total 11 chargesheeted witnesses but none of them came forward to adduce the evidence. Petitioner is in custody since 19.06.2023 and has two criminal case pending
Patna High Court CR. MISC. No.20402 of 2024(4) dt.26-06-2024 2/2 against him in which he is on bail.
4. Learned APP for the State opposes the prayer for bail.
5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st Bagha, West Champaran in connection with S.Tr. No. 29/2024 arising out of P.S. Case No. 285/2023 subject to the condition laid down under Section 437(3) of the Cr.P.C.
6. However, the petitioner shall be granted bail only on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are as follows:- • Ramnagar P.S. Case No. 160/2019 • Ramnagar P.S. Case No. 480/2017 (Dr. Anshuman, J) Sunnykr/- U
