18-06-2015 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in connection with Madhepura P.S. Case No. 105 of 2013 registered for the offence under Sections 406, 409, 420 and 120(B) of the Indian Penal Code, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that in similar circumstance, the petitioner was made accused in another case, in which, he has already been granted bail by this Court by order dated 25-11-2014 passed in Cr. Misc. No. 41901 of 2014. He submits that the petitioner in the present case has falsely been implicated. He further submits that other co-accused persons have already been extended the privilege of anticipatory bail.

Patna High Court Cr.Misc. No.20044 of 2015 (2) dt.18-06-2015 2/2 Besides hearing, I have also perused the materials available on record. In the present case, it is a case of misappropriation of amount of paddy to the tune of Rs. 2,93,65,295/- (two crores ninety three lacs sixty find thousand two hundred & niney five) and the petitioner was the proprietor of M/s Saha Rice Mill, Asarganj, Munger.

Be that as it may, keeping in view the seriousness of the accusation and the fact that the petitioner was proprietor of M/s Saha Rice Mill, Asarganj, Munger, I am not inclined to extend the privilege of anticipatory bail.

The petition stands dismissed.
