This application is for grant of regular bail in connection with G.R.P. (DBG) SMI P.S.Case No.61 of 2017 , registered for the offences punishable under Sections 370/34 of the Indian Penal Code and Section 79 of J.J. Act, 2015. Allegation against the petitioners is of human trafficking by carrying five children (all minor) along with them to Bombay.
Submission of the learned counsel for the petitioner is that father of those children have not supported the prosecution case and they have been falsely implicated in this case. The petitioners are in custody since 17.7.2017.
Patna High Court Cr.Misc. No.37830 of 2017 (3) dt.31-08-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the children recovered have stated about involvement of the petitioner.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioners, however, the petitioners may renew his prayer for bail before the court concerned after framing of charge in this case.
With the aforesaid observation, this application is dismissed.
