JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 395/397 of the Indian Penal Code.
The FIR of the occurrence of dacoity is against unknown. The petitioner is in custody since 15.01.2017. Submission is that name of the petitioner surfaced during trial only for the reason that on the basis of call details it was found that looted mobile was in possession of the petitioner. Considering the nature of material and the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/-
Patna High Court Cr.Misc. No.21901 of 2018 (2) dt.19-04-2018 P2/ (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kahalgaon P.S. Case No.371 of 2016, Sessions Trial No.507 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
