====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 14-05-2025 Heard Mr. Sanjeet Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Narendra Kumar Singh, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Mufassil P.S. Case No. 26 of 2025 registered for the offence punishable under Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956.

3. As per the allegation made in the F.I.R., petitioner is the owner of the Khana Junction Hotel where immoral act was being carried out. Specific allegation is against the Manager of the Hotel.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is not involved in any manner in immoral activity to be carried out in his hotel

Patna High Court CR. MISC. No.14650 of 2025(4) dt.14-05-2025 2/3 premises rather specific allegation is against the Manager of the hotel. Otherwise also, it is submitted that prior to the present case, no case of immoral act has been reported against the petitioner.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having considered the rival submissions made on behalf of the parties, the petitioner has claimed that he is the owner of the hotel and the alleged activity were carried out in the said hotel in connivance of the Manager of the hotel, learned District Court is directed to verify as to whether this is the first act which has been reported against the petitioner, in that case, the petitioner, above named, is directed to be released on prearrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Chapra Mufassil P.S. Case No. 26 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner

8. The bail application stands disposed of.
