Petitioner seeks bail in Barhara P.S. Case No.121 of 2018 instituted for the offence under Section(s) 396 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. No incriminating article has been recovered from his possession. Name of the petitioner has come during investigation in the confessional statement of Sri Ram Bind.

Counsel for the petitioner further submits that similarly situated co-accused, Asnandan Bind, has already been granted regular bail by this Court by order dated 06.12.2018

Patna High Court CR. MISC. No.14454 of 2019(2) dt.08-03-2019 2/2 passed in Cr. Misc. No.72541 of 2018.

Petitioner is in custody since 25.06.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara, in connection with Barhara P.S. Case No.121 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
