The petitioner is languishing in custody in a case registered for the offences punishable under Sections 323, 498(A), 494, 504, 506/34 of the Indian Penal Code.

The accusations are of torture for nonfulfillment of dowry demand and performing second marriage.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the informant. There is general and omnibus allegation

Patna High Court CR. MISC. No.18394 of 2023(2) dt.12-05-2023 2/2 against the petitioner. The marriage was performed twelve years before filing of the complaint. The petitioner is still ready to keep the informant as wife with full dignity and honour. The petitioner is languishing in custody since 17.11.2022.

Considering the fact that marriage was performed twelve years prior to the filing of the complaint and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 20 of 2022.
