The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 307, 427, 379, 504 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, the petitioner along with other accused persons said to have fired upon the informant's cousin causing firearm injury to him. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is no specific overt act against the petitioner. There is specific

He submits that the petitioner is the own brother of the informant and there is admitted land dispute between the parties. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
Learned APP for the State opposes prayer for anticipatory bail.
Considering the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Islampur P.S. Case No. 284 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
