JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner is languishing in custody since 30.09.2018 in a case registered for the offences punishable under Sections 420, 467, 468, 506 and 120B of the Indian Penal Code.

The prosecution case is that the petitioner transferred the land of the informant in spite of the fact that he lost the Money Suit, Title Suit, Appeal and SLP up to the Supreme

It is submitted by learned counsel for the petitioner that the transfer was being made by the petitioner of the land of his own share and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

It is submitted by learned counsel for the informant that in spite of the fact that petitioner lost the civil suit up to the Supreme Court in dispute with regard to the land in question, he transferred the land in favour of his cousin brother and threatened the witnesses.

Considering the genesis of the occurrence vis-a-vis land dispute and the fact that the investigation has already been concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhojpur at Ara in connection with Tiyar P.S. Case No. 54 of 2018.

The learned Court below will be at liberty to cancel
