The petitioner apprehends his arrest in connection with Excise Case No. 286 of 2019 for the offence registered under Section 30 (a) of the Bihar prohibition and Excise Act, 2018.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has no criminal antecedent.
Learned counsel for the State has opposed the prayer for bail and submits that on perusal of the seizure list, it appears that the alleged recovery has been made from the vehicle of the
Patna High Court CR. MISC. No.16073 of 2020(2) dt.12-06-2020 2/2 petitioner. Hence, he is not entitled to grant anticipatory bail. Having considered the facts and circumstances of the case, I am not inclined the grant anticipatory bail to the petitioner. It is, accordingly rejected.
