2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 120(B) and 34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per the prosecution case, co-accused Buggi Thakur fired upon the deceased due to which he died. Informant has raised suspicion that the petitioner in connivance with coaccused Buggi Thakur killed the husband of the informant (deceased).
4. It is submitted on behalf of the petitioner that specific accusation of causing fire arm injury is against Buggi Thakur and only on the basis of suspicion this petitioner has
Patna High Court CR. MISC. No.21876 of 2024(2) dt.04-04-2024 2/2 been made accused in this case . Except suspicion there is no direct or indirect evidence against this petitioner to show his complicity in the present case. Police after investigation submitted final form against this petitioner and found the case untrue .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Begusarai in connection with Begusarai P.S. case No. 521 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
