The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code has been added.

Petitioner's prayer for bail has been earlier rejected twice vide order dated 10.11.2015 passed in Cr. Misc. No.51019 of 2015 and again vide order dated 17.08.2016 passed in Cr. Misc. No.32902 of 2016.

On earlier occasion, report was called for with respect to the stage of the trial.

Perused the report kept at Flag A. It has been stated

Patna High Court Cr.Misc. No.50861 of 2017(3) dt.18-01-2018 2/2 that six witnesses have not been examined as yet, however, summons have been issued on the witnesses for assuring their attendance and on 12.12.2017 bailable warrants have also been issued against the witnesses.

However, since there is direct allegation of assault by the petitioner by bow and arrow causing fatal injury on the deceased and his application for bail has already been rejected twice on earlier occasion, this Court is not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.

However, in the facts and circumstances of the case, the trial court is directed to conclude the trial within a period of six months.
