JUSTICE RAMESH KUMAR DATTA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner and learned counsels for the State and for the Accountant General, Bihar. The direction of this Court by order dated 13.9.2012 passed in CWJC No. 16255 of 2008 was to reckon the period of service commencing from daily wage for the purposes of ACP and pensionable service in the light of earlier decision of another learned Single Judge of this Court.
On the basis of the written instructions learned counsels for the State and Accountant General, Bihar submit that the pension payment order and gratuity payment order of the petitioner have already been issued on 5.6.2015 and thus the order under contempt stands complied with.
Learned counsel for the petitioner submits that he is unable to obtain any instruction from the petitioner. In view of the submissions made by learned counsels for the opposite parties, the contempt application is dismissed. (Ramesh Kumar Datta, J) spal/- U
