JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sasaram (Tilauthu) P.S. Case No. 1751 of 2017, registered under Sections 30(a) and 37(b) of the Bihar Excise Act, 2016. The accusation is that, in course of patrolling duty, petitioner was apprehended in drunken state and on the disclosure of the petitioner, 20 litres country made liquor was recovered from the bush situated in forest land.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner has no criminal

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-Cum-Special Judge, Excise Rohtas at Sasaram, in connection with Sasaram (Tilauthu) P.S. Case No. 1751 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
