The petitioner who is in custody since 09.05.2017 in Special Case No. 1198 of 2017 [ arising out of Bihta P.S. Case No. 301 of 2017] registered for the offence under section 272/ 273 of the Indian Penal Code , 1860 , section 30(a)/ 37(b)(c) of the Bihar Prohibition and Excise Act , 2016 ] has prayed for grant of bail. By way of referring to the statement made in paragraph no. 3 of the petition it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and on false accusation petitioner was apprehended. He submits that petitioner in the morning had gone to attend natural call on the Bank of river Sone however at that very time recovery of about 40 liter
Patna High Court Cr.Misc. No.39387 of 2017 (2) dt.19-08-2017 2/2 country made liquor was shown and petitioner was apprehended and besides petitioner altogether 18 persons were made accused. Considering the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner Tejan Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna / concerned court in connection with Special Case No. 1198 of 2017 (arising out of Bihta P.S.
