The petitioner has preferred this application for grant of regular bail in a case registered under sections 30 and 38(4) of the Bihar Prohibition and Excise Act, 2016 As per the prosecution case, on information having been received a raid was conducted. Seeing the police personnel the accused persons managed to escape. 4000 litres of spirit was recovered hidden in the truck. It is stated that the local people disclosed the petitioner to be amongst the accused persons involved in the trade of liquor which had been brought for Holi festival.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any

The cause of his false implication is his antecedent under the Bihar Prohibition and Excise Act, 2016. The petitioner is in custody since 31.12.2020 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Isuapur P.S. Case no. 31 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra.
