1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323, 420, 467, 468, 120(B) and 34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that from perusal of the office report dated 08.05.2024, the same records that addressee refused to accept the registered notice. Since the O.P. No.2 refused to accept the notice, as such, it is deemed to have been validly served.

4. The learned counsel for the petitioner next submits that petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant. It is further submitted that O.P. No.2 deliberately refused to accept the notice knowing that he does not have a case. It is next submitted that petitioners are employees of Shri Ram Finance and the informant had purchased a truck after obtaining loan from the finance company and when the loan amount mounted and the informant was not able to repay the same, the instant complaint case came to be implicated to coerce the petitioners into submission as they were repeatedly approaching the informant for repaying the loan.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Dariyapur
