JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 01-05-2018 The sole appellant herein namely, Bishundeo Sharma, son of Late Musafir Singh has filed this appeal challenging his conviction order passed by the learned Additional Sessions Judge - IInd, Patna in Session Trial No. 197/90 for the offences under Sections 302, 302/34, 307/34 of the Indian Penal Code and 27 of the Arms Act.

On 13th July, 2017, it was orally reported to this court that the appellant Bishundeo Sharma, son of Late Musafir Singh had died and, therefore, this court called for a report from the Superintendent of Police, Patna and the Superintendent of Police, Patna has submitted his report on 17th July, 2017 which goes to show that the sole appellant namely, Bishundeo Sharma, son of

Patna High Court CR. APP (DB) No.430 of 1993 (4) dt.01-05-2018 Late Musafir Singh, resident of village - Moriawan, P.S. - Bikram, district - Patna has died on 22.12.1997 and the documents and certificates evidencing the same has been submitted by the Superintendent of Police, Patna which is kept on record of the connected case in Cr. Appeal (DB) No. 414/1993. Considering the fact that the sole appellant namely, Bishundeo Sharma, son of Late Musafir Singh, resident of village - Moriawan, P.S. - Bikram, district - Patna has expired, this appeal is dismissed as having been abated.
