JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 30.12.2019 and is a person of clean antecedent, seeks bail in connection with Sonbarsa P.S. Case No. 287 of 2019 dated 29.12.2019 instituted for the offence under Section 414 of the Indian Penal Code and 30(a), 38, 41, 42 and 44 of the Bihar Prohibition and Excise Act. It appears that 428.400 litres of Nepali liquor is said to have been recovered from a Bolero vehicle. The petitioner does not claim the ownership of the vehicle. Because some of the persons were arrested while fleeing away, the petitioner also was nabbed by the police on mistaken identity.

The petitioner does not have any concern with the consignment of the liquor which is said to have been recovered from the vehicle.

Patna High Court CR. MISC. No.13276 of 2020(2) dt.03-03-2020 2/2 Regard being had to the period of custody of the petitioner and his being a person of clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 2nd -cum-Special Judge, Excise Act, Sitamarhi in connection with Sonbarsa P.S. Case No. 287 of 2019.
