The petitioner has renewed the prayer for bail in a case registered for the offences punishable under sections 411, 419, 420, 467, 468 and 471/34 of the Indian Penal Code. Prosecution case is that on secret information two stolen motorcycles were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that though the petitioner is accused in four other cases apart from the present one, the details of which has been mentioned in paragraph no.3 of the petitioner, but he has been acquitted in two cases and in one case he is on bail. No.14698 of 2016 (4) dt.01-03-2016 2/2 accused Umesh Yadav, who is accused in six other cases, has been granted bail by a co-ordinate Bench of this Court vide order dated 17.08.2015 passed in Criminal Miscellaneous No.32586/2015 whereas co-accused Mohan Pandey from whom stolen motorcycle was recovered, is also accused in three other cases, has also been granted bail by a co-ordinate Bench of this Court vide order dated 30.09.2015 passed in Criminal Miscellaneous No.45354 of 2015. The petitioner is languishing in custody since 09.08.2014.

The earlier bail application of the petitioner was rejected vide Criminal Miscellaneous No.22371/2015 with observation at present.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chapra in connection with Jalalpur P.S. Case No.104/2014. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for three consecutive occasions or gets involved in some serious nature of offence.
