The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 182, 211, 407, 192, 420 and 411 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that while he and the khalasi had gone to have meal, on return he found their truck to have disappeared with the goods loaded thereon.

It is submitted by learned counsel for the petitioner that the petitioner happens to be the informant of this case. In course of investigation he was falsely implicated on the basis that he was stated to be in contact on telephone with co-accused Mohsin Khan who admitted his guilt in his confessional statement. It is further stated that the truck along with the goods

Patna High Court CR. MISC. No.25064 of 2021(2) dt.22-11-2021 2/2 were recovered in the State of West Bengal and the aforesaid coaccused Mohsin Khan has been enlarged on bail vide order dated 20.7.2021 passed in Cr. Misc. No. 19428 of 2021. The petitioner is in custody since 5.11.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 1 year and grant of bail to the aforesaid accused Mohsin Khan, the petitioner is directed to be enlarged on bail in connection with Kudra P.S. Case no. 334 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Kaimur at Bhabhua.
