====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Valmikinagar P.S. Case No. 15 of 2021 lodged under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018. The prosecution case is that, the petitioner alongwith 7 known and 3 unknown persons were preparing local wine near Ban Bahari Forest. The recovered wine as per the seizure list is total 50 liters situated in the south of Semri Deeh Village namely Ban Bahari Forest.
Learned counsel for the petitioner submits, that the name of the accused persons were disclosed by the local persons present there. Learned counsel for the petitioner further submits
Patna High Court CR. MISC. No.15481 of 2022(4) dt.25-07-2022 2/2 that petitioner is in custody since 06.09.2021, charge sheet has already been filed in this case and he has having clean antecedent.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bagaha, West Champaran in connection with Valmikinagar P.S. Case No. 15. of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. and one of the bailor shall be the close relative of the petitioner.
With this observation, the bail application stands allowed.
